Know Your Rights: Immigration Enforcement

ڰAPP and leaders will continue to advocate at all levels of government for the rights of our diverse student population to obtain a quality education.
 

Rights, Responsibilities & Resources for ڰAPP Faculty and Staff

Follow these steps if a federal immigration official is on campus and requests access to student information, district records, or entrance to a facility.
 
1. REMAIN CALM AND PROFESSIONAL 
ڰAPP and its employees have state legal procedures and district policies we must follow. Immigration officers are required to abide by state laws.

2. ASK FOR IDENTIFICATION AND COMMUNICATE
Ask the official to identify themselves by name, identification number, and agency. Politely state, “I am not obstructing your process, but I am not the designated campus official. Please allow me to contact my supervisor.” 
 
3. NOTIFY THE COLLEGE PRESIDENT
Ask the area supervisor to refer the official to the ڰAPP President by phone at  209-575-6067 or in-person ڰAPP East Campus , Rm 201, during business hours. After hours, contact Campus Safety at 209-575-6351.
 
 
Frequently Asked Questions (FAQs)
Can I release student information to law enforcement officials?
No, any release of student information to law enforcement must be authorized by the ڰAPP President.  Student information is governed by the Family Educational Rights and Privacy Act (FERPA) and and Administrative Procedure .
 
Will Yosemite Community College District (YCCD) Campus Safety enforce federal immigration laws?
  • No.  YCCD Campus Safety personnel do not have access to student immigration status.
  • YCCD Campus Safety will:
    • Not enter into agreements with law enforcement agencies or federal departments for the enforcement of federal immigration law.
    • Not honor immigration hold requests
    • Not contact, detain, or question individuals solely on the basis of declared or suspected immigration status.
Since ڰAPP is an open campus, can law enforcement officials access all areas of campus without permission?
No. YCCD /-Campus Security and Access states that classrooms and other instructional areas are limited to students and employees of the college and staff areas are accessible to assigned employees and by invitation to others for college business. Exigent circumstances, warrant verification, and/or subpoenas are required for access.
 
Are there different rules for international students?
No. Campus policies also pertain to international students.
 
 

Public Space versus Private Space

As a community college, areas of ڰAPP are considered public spaces. However spaces have designations, as defined below,  to ensure that peace and order can be maintained. 

  • Classrooms are limited to students, college employees, and participants in authorized programs. Instructor permission is required for all others.
  • Instructional Areas are limited to students, college employees, and participants in authorized programs. Instructor permission is required for all others.
  • Staff Areas are limited to employees and those invited by employees to enter.

Visit the for helpful videos, campus resources and community organizations that can provide a variety of support services including free immigration legal services, assistance understanding your basic rights, and more. 

 

 

Employment Assistance Program

Resources are available to all staff experiencing hardships due to immigration enforcement efforts. Included in your employee benefits from (YCCD), you and your dependents have access to an that can provide assistance with legal services, child care, elder care and more.
